To receive a pension, 3 conditions must be met:

  • have insurance;
  • reach the required age;
  • have a minimum experience.

If a citizen does not have any experience, the state will provide the minimum needs of the citizen. However, there are additional conditions for receiving a payment, the main of which is an increased retirement age.

How it is formed

Federal Law No. 400 establishes that the pension is formed according to the calendar principle. This means that the calculation of the length of service comes from the actual output of a citizen: 1 year of work is considered one year of experience. If a citizen went on leave to care for a relative or on maternity leave, then these periods are counted as seniority.

Lawyers, notaries, self-employed persons and any self-employed citizens (including writers and authors who receive commissions for copyright works) are considered officially employed and can count on a pension if they regularly made contributions to the chosen fund.

Their experience is not considered in years, like the rest, but in the number of months for which they made payments.

Federal Law No. 400 determines that if a citizen receives pension contributions in another state, they do not affect the amount Russian pension. Foreign experience and payments are not taken into account when calculating a pension in the Russian Federation.

If a citizen has already been paid a pension for long service, then when the insurance part is calculated in the Pension Fund of the Russian Federation, only the civil service will be taken into account, which is not included in the amount state pension. The rules and requirements for the insurance pension do not change.

When calculating seniority Pension Fund also takes into account special periods established by law:

  • the time of treatment, which the citizen confirms with documents;
  • service in the army or any other state power structures;
  • if the citizen was unemployed, but at the same time was registered with the Employment Center;
  • maternity leave and time allotted for the care of a minor;
  • time spent caring for an incapacitated or elderly relative;
  • periods in prison;
  • study, if the student was officially employed at that time.

The minimum insurance period for the appointment of an old-age pension

The state every year gradually tightens the period of minimum work experience by 1 year. The trend will continue until 2024, until citizens retiring need to work 15 years and officially confirm the length of service.

However, achieving a sufficient number of years of service does not guarantee increased pension. In 2015, the law was amended, according to which pension contributions are affected by special points, the number of which depends on the salary.

In each year, the number of points is determined, more than which it is impossible to score. In 2020, the value was 8.26, in 2020 - 8.90 points. By 2021, it is planned to increase the number of points to 10.

At the moment, this system does not greatly affect pension contributions, since a citizen is required to score only 11.4 points for the entire time of work. However, the value will gradually increase, in 2025 30 points will be required. The state justifies the introduction of an additional calculation by linking the pension to the size of the salary of citizens.

For women

For women, retirement features include:

  • when a woman reaches the age of 55, she begins to receive pension contributions. If a woman does not have official experience, she retires 5 years later (at age 60).
  • in 2018, women must officially work for at least 9 years. Their minimum period is gradually increased by a year, as in men.
  • if a woman was on parental leave, it is taken into account when calculating the length of service (until the minor reaches 3 years).

For men

In most regions of the Russian Federation, men retire at the age of 60. They also have access to an additional pension for long service when employed in state or municipal structures.

Depending on the chosen profession and subject to certain grounds established by Russian law, men can retire at age 45 or earlier. A man's seniority includes conscription military service, as well as military business trips abroad.

Military pensioners

In 2020, new rules were established for calculating and forming a pension, which applies to military pensioners.

They are entitled to a second pension from the FIU if all of the following conditions are met:

  • reaching the required age (55 years for women and 60 years for men). If there are conditions for early appointment, some categories of military pensioners are entitled to an early old-age pension. For example, if a citizen works in the Far North, in places with difficult working conditions, etc.;
  • the presence of a minimum official length of service not taken into account when calculating the second pension through the power department. Military pensioners follow the same rules as other citizens - in 2020, their indicator must be at least 9 years old;
  • the presence of a sufficient number of points, which is also gradually increasing and will increase from 13.8 points in 2020 to 30 points in 2025;
  • the presence of a disability pension in the force statement or for length of service.

When calculating the minimum length of service for a military pensioner for the payment of a second pension, the periods of activity that were taken into account when calculating the first pension are not included.

How to confirm

Article 13 of the Federal Law on Pensions establishes the possibility of confirming the length of service according to the testimony of witnesses, if the citizen does not have entries in the work book or if the enterprise where he worked was not officially registered.

The specific procedure for determining the length of service is regulated by the Rules for calculating and is considered in each case individually.

Witness testimony is allowed to confirm only the length of service that was carried out before the registration of a citizen as an insurance person.

In 1996 was adopted the federal law 27 "On individual accounting in the insurance system", according to which testimonies in the implementation of certain types of activities (for example, military service) are not taken into account.

Witnesses are allowed to be involved only if there are no documents and individual records on the implementation of labor activities.

In this case, the applicant will need to indicate the reasons for the loss of documents and prove the authenticity of these witnesses (for example, joint photographs from the place of work).

If not enough

If a citizen does not have a sufficient number of years or points for the minimum pension experience to old age, the state will begin to pay a social pension in the amount of the subsistence minimum in the region of residence. In some subjects, there are special allowances and benefits (for example, in districts far north), which increase the size of the pension to the standard.

The main disadvantage of the absence of a minimum length of service is the age when the state begins to pay social support. For men it is 65 years, for women it is 60 years, 5 years later than for the standard pension.

Any citizen of the Russian Federation has the right to receive a pension (and in some cases two), the amount of which depends on the length of service and the points scored. The minimum experience in 2020 is 9 years and will continue to grow until 2025.
